People under the influence of alcohol or drugs

129. People under the influence of alcohol or drugs



(1) A person who is adversely affected by alcohol or a drug must not-

   (a)  be in any part of a factory or licensed premises where explosives are
        manufactured or stored; or

   (b)  make an explosive mixture or handle or use explosives; or

   (c)  be in or on a road or rail vehicle, or a vessel, while it has
        explosives aboard.

(2) For the purposes of subregulation (1), a person is adversely affected by
alcohol or a drug if the alcohol or drug reduces the person's mental or
physical ability to the extent that the person could cause an accident
involving explosives.

(3) If a licence holder under any Part of these Regulations or any other
person in control of explosives suspects that a person is adversely affected
by alcohol or a drug-

   (a)  the licence holder or person authorised by the licence holder to have
        immediate control of the explosives may order the affected person away
        from the area where the explosives are, or from the vehicle or vessel;
        and

   (b)  the affected person must comply with the order.
