Authority may grant class exemptions on its own motion
116. Authority may grant class exemptions on its own motion
(1) The Authority may grant on its own motion an exemption from compliance
with a regulation in respect of a class of people, activities, premises or
licence holders.
(2) The Authority must not grant an exemption under subregulation (1) unless
it is satisfied that the exemption will achieve a level of health and safety
of people, and a level of safety of property, that is at least equivalent to
that which would be achieved by observance of the relevant provision or
provisions.
(3) An exemption granted under this regulation must be issued in writing.
(4) The Authority may impose any of the conditions listed in regulation 115(6)
on an exemption granted under this regulation.
(5) A person to whom an exemption has been granted must comply with each
condition that applies to the exemption.
