Prime contractors and rail operators

22. Prime contractors and rail operators



(1) A person is the prime contractor for the transport of dangerous or other
goods by road if the person, in conducting a business for or involving the
transport of dangerous goods by road, has undertaken to be responsible, or is
responsible, for the transport of the goods by road.

(2) A person is a rail operator for the transport of dangerous or other goods
by rail if the person has undertaken to be responsible, or is responsible,
for-

   (a)  the transport of the goods by rail; or

   (b)  the condition of a unit of rolling stock transporting the goods.
