Corporation or Minister may bring proceedings

19. Corporation or Minister may bring proceedings



(1) If a person contravenes section 18 in relation to the Corporation, the
Corporation or the Minister, in the name of the Corporation, may recover from
the person as a debt due to the Corporation by action in a court of competent
jurisdiction either or both of the following-

   (a)  if that person or any other person made a profit as a result of the
        contravention, an amount equal to that profit;

   (b)  if the Corporation has suffered loss or damage as a result of the
        contravention, an amount equal to that loss or damage.

(2) Despite subsection (1), the Corporation or the Minister cannot recover
under this section if, by force of section 22, a member of the Board is not
personally liable for a contravention of section 18.
