Report on investigation

63. Report on investigation



(1) On the completion of an investigation of a disclosed matter the Ombudsman-

   (a)  must report the findings of the investigation to the relevant person;
        and

   (b)  may make recommendations as to the action to be taken as a result of
        the investigation.

(2) For the purposes of subsection (1), the relevant person is-

   (a)  in the case of a public body or public officer, either the relevant
        Minister or the chief executive officer of the public body;

   (b)  in the case of a councillor, either the relevant Minister or the mayor
        of the relevant municipal council.

(3) Recommendations under subsection (1) may include-

   (a)  a recommendation that the disclosed matter be referred to an
        appropriate authority for further consideration;

   (b)  a recommendation that action be taken to remedy any harm or loss
        arising from the conduct;

   (c)  a recommendation that action be taken to prevent the conduct from
        continuing or occurring in the future.

(4) This section does not apply to an investigation of a disclosed matter that
relates to a member of the police force.
