To whom can a disclosure be made?

6. To whom can a disclosure be made?



(1) Subject to this section, a disclosure under this Part may be made to-

   (a)  the Ombudsman; or

   (b)  if the disclosure relates to a member, officer or employee of a public
        body, that public body.

(2) A disclosure that relates to a member of Parliament must be made to-

   (a)  the President of the Legislative Council, if the member is a member of
        the Legislative Council; or

   (b)  the Speaker of the Legislative Assembly, if the member is a member of
        the Legislative Assembly.

(3) A disclosure that relates to a councillor must be made to the Ombudsman.

(4) A disclosure that relates to the Chief Commissioner of Police must be made
to the Ombudsman or the Director.



(5) A disclosure that relates to any other member of the police force may be
made to-

   (a)  the Ombudsman; or

   (b)  the Director; or





   (c)  the Chief Commissioner of Police.

(6) A disclosure-

   (a)  may be made orally or in writing; and

   (b)  must be made in accordance with the prescribed procedure.

(7) A disclosure made in relation to a member of Parliament is not to be taken
to be a contempt of Parliament.
