Notice of the investigation

50. Notice of the investigation



(1) Before conducting an investigation of a disclosed matter, the Ombudsman
must in writing inform the relevant person or body listed in subsection (2) of
his or her intention to do so.

(2) For the purposes of subsection (1) information must be given to-

   (a)  if the disclosed matter relates to a public body or a public officer,
        either the relevant Minister or the chief executive officer of the
        public body; or

   (b)  if the disclosed matter relates to a mayor of a municipal council,
        either the relevant Minister or the chief executive officer of the
        relevant municipal council; or

   (c)  if the disclosed matter relates to a councillor (other than the mayor)
        of a municipal council, the mayor and the chief executive officer of
        the relevant municipal council; or

   (d)  if the disclosed matter relates to the chief executive officer of a
        municipal council-

   (i)  the relevant Minister; or

   (ii) the mayor of that council and a senior officer (within the meaning of
        the Local Government Act 1989) of that council nominated by that
        council; or

   (e)  if the disclosed matter relates to any other officer or employee of a
        municipal council, the mayor and the chief executive officer of the
        relevant municipal council.

(3) This section does not apply to an investigation of a disclosed matter that
relates to a member of the police force.
