WATER INDUSTRY ACT 1994 - SECT 178
Offences by bodies corporate(1) If a body corporate commits an offence against this Act or the regulations, any officer of the body corporate who was in any way, by act or omission, directly or indirectly, knowingly concerned in or party to the commission of the offence is also guilty of that offence and liable to the penalty for it, irrespective of whether the body corporate has itself been prosecuted for, or convicted or found guilty of, the offence.
(2) If in a proceeding for an offence against this Act or the regulations it is necessary to establish the intention of a body corporate, it is sufficient to show that a servant or agent of the body corporate had that intention.
(3) A statement made by an officer of a body corporate is admissible as evidence against the body corporate in any proceeding for an offence against this Act or the regulations.
