Compensation

33B. Compensation



(1) The Minister, or a person authorised in writing by the Minister for a
purpose referred to in section 33A, must cause as little damage and
inconvenience as possible in the performance of his or her functions under
this Division.





(2) The Minister is liable to compensate any person who has-

   (a)  sustained any pecuniary loss; or

   (b)  incurred any expense-

as a direct, natural and reasonable consequence of the performance of a
function under this Division by the Minister, or a person authorised in
writing by the Minister for a purpose referred to in section 33A.

(3) The Minister is not liable to compensate a person for consequential loss.

(4) Any claim for compensation must be made and dealt with in accordance with
the Land Acquisition and Compensation Act 1986 as if it were a claim under
section 47(1) of that Act.
