Certain plans deemed to be approved management plans
32E. Certain plans deemed to be approved management plans
(1) Despite anything to the contrary in this Division but subject to this
section, the Minister may approve a plan for the management of surface water
resources that has been prepared or partly prepared by or for the department
for a particular area before the commencement of section 10 of the Water
(Irrigation Farm Dams) Act 2002.
(2) Before approving a plan as a management plan under subsection (1), the
Minister may-
(a) review or revise the plan; or
(b) appoint an advisory committee to assist in developing or completing
the plan.
(3) An advisory committee is to consist of such persons as the Minister thinks
fit.
(4) The Minister must not approve the plan unless the Minister is satisfied
that the plan complies with section 32A(1) to (5).
(5) On the approval by the Minister of a plan under subsection (1)-
(a) the particular area to which the plan relates is deemed to be a water
supply protection area for the protection of surface water resources;
and
(b) the plan is deemed to be an approved management plan for the surface
water resources of the relevant water supply protection area and may
be amended or revoked in accordance with this Division.
