Disposal of seized things

70A. Disposal of seized things



(1) If a person is found guilty by a court of an offence against this Act, the
regulations or any proclamation made under this Act, the court may, in
addition to imposing any other penalty, order any thing seized under this Act
which relates to that offence to be destroyed or otherwise disposed of in the
manner specified in the order.

(2) The Magistrates' Court may, on the application of an authorised officer,
order that any thing seized under this Act be destroyed or otherwise disposed
of, if the Court is satisfied that-

   (a)  the owner of the thing cannot be found; or

   (b)  in the case of wildlife, the person apparently in possession of the
        wildlife does not hold a licence, authorisation or permit under this
        Act to do so.
