Authorised officers do not commit offences in certain circumstances

63. Authorised officers do not commit offences in certain circumstances



(1) An act done by-

   (a)  an authorised officer; or

   (b)  a member of the police force; or

   (c)  a member of a police force of the Commonwealth or of another State or
        a Territory-

which, but for this subsection, would constitute an offence against section
41, 42, 43, 45, 46, 47, 47D, 50, 51 or 76, does not have that consequence if
the act is done under written instructions given in relation to a particular
case by the Secretary.

(2) The Secretary must not give instructions to an authorised officer under
subsection (1) unless the Secretary is satisfied that the authorised officer
has the appropriate qualifications, training and experience to carry out the
act in respect of which the instructions are given.
