Requirements as to taking samples, seizing

60B. Requirements as to taking samples, seizing



(1) An authorised officer or member of the police force may not take samples
of a thing or seize a thing apparently in the possession of a person unless
the officer or member makes out or tenders to the person a written receipt for
the sample taken or thing seized.

(2) If the officer or member is unable to ascertain the identity of the owner
or custodian of the thing seized or sampled, the officer or member must leave
a receipt with or post it to the person apparently in charge of the thing
seized.

(3) If an officer or member seizes a thing he or she must take reasonable
steps to return the thing to the person from whom it was seized if the reason
for its seizure no longer exists.
