Occupier entitled to be present during search

59F. Occupier entitled to be present during search



(1) If a search warrant is being executed, and the occupier or a person
apparently in charge of the premises in respect of which the warrant is being
executed is present at those premises, the person has a right to observe the
search being conducted.

(2) The right to observe the search being conducted ceases if the person
impedes the search.
