PART V CONTRIBUTORY NEGLIGENCE

Definitions

25. Definitions

In this Part unless inconsistent with the context or subject-matter-

court means, in relation to any claim, the court or arbitrator by or before
whom the claim falls to be determined;

damage includes loss of life and personal injury;

dependant means any person for whose benefit an action could be brought under
Part III of this Act;

wrong means an act or omission that-

   (a)  gives rise to a liability in tort in respect of which a defence of
        contributory negligence is available at common law; or

   (b)  amounts to a breach of a contractual duty of care that is concurrent
        and co-extensive with a duty of care in tort.
