Form of transfer

45. Form of transfer



(1) A registered proprietor may transfer his estate or interest in land by an
instrument in an appropriate approved form.

(2) Upon the registration of the transfer the estate or interest of the
proprietor as set out in such instrument or which he is entitled or able to
transfer or dispose of under any power, with all rights powers and privileges
thereto belonging or appertaining, shall pass to the transferee; and such
transferee shall thereupon become the registered proprietor thereof.

(3) The Registrar must not register an instrument that creates or surrenders a
right of carriageway unless satisfied that the Council of the municipal
district in which the land is located has consented to the creation or
surrender of the right of carriageway.
