Priority of interests

26I. Priority of interests

Despite anything to the contrary in this Act, the priority of any interest in
land recorded on a folio created under this Division in relation to any
subsisting interest must be determined as if-

   (a)  the land were not under the operation of this Act; and

   (b)  the interest could have been registered under section 6 of the
        Property Law Act 1958 at the time that it was recorded on the folio
        and was so registered.
