Order for account
27. Order for account
(1) If the Minister in respect of an estate or a person who is a trustee,
cestui que trust, executor, legatee, administrator, spouse, domestic partner,
next of kin, creditor or minor entitled to or interested in an estate which
has come (or comes) into the possession or under the control of a trustee
company is unable, upon application to the managing director or manager of the
trustee company, to obtain a sufficient account of the property and assets of
which the estate consists and of the disposal and expenditure of or out of the
estate, the Minister or that person, may apply to the Supreme Court for an
order under this section.
(2) If, on an application under subsection (1), the Supreme Court is of
opinion that no sufficient account has been rendered by the trustee company,
the Supreme Court shall order such account to be rendered by the trustee
company as to the Supreme Court seems just, or if the Supreme Court thinks
that no sufficient case has been established to require the trustee company to
furnish an account, the Supreme Court may dismiss the application and in all
cases may make such order as to costs either against the trustee company or
against the applicant or as to payment of costs out of the estate as to the
Supreme Court seems right.
