Trustee company may be removed from office by Supreme Court
26. Trustee company may be removed from office by Supreme Court
(1) In every case in which a trustee company has been or is appointed to any
office referred to in section 14, 16 or 17 or under any power of attorney the
trustee company, in addition to the liabilities and restrictions imposed by
this Act, is subject in all respects to the same control and liable to removal
in the same manner as a private individual who may be appointed executor,
administrator, trustee, guardian or attorney would be.
(2) It shall be lawful for all persons who may claim relief against a trustee
company for any act done or assumed to be done or in respect of any act
omitted to be done by the trustee company, its directors or officers under any
of the powers conferred by this Act to apply to the Supreme Court or in any
other court of competent jurisdiction for an order against the trustee company
or against any of its directors or officers and the court may make and enforce
such order in the matter as to the court seems just.
