Assessment of impairment

46B. Assessment of impairment



(1) In determining a degree of impairment of a person, regard must not be had
to any psychiatric or psychological injury, impairment or symptoms arising as
a consequence of, or secondary to, a physical injury.

(2) Subsection (1) applies to a determination of a degree of impairment under
this Act made on or after the commencement of section 35 of the Accident
Compensation (Further Amendment) Act 1996, other than a determination made by
the Administrative Appeals Tribunal in respect of an application for review
under section 77 of this Act made before that commencement.
