Powers of the Commission

13. Powers of the Commission



(1) The Commission has power to do all things necessary or convenient to be
done for or in connexion with the performance of its functions and to enable
it to achieve its objectives.

(2) Without limiting or derogating from subsection (1), the Commission may
enter into agreements or arrangements and settle or compromise differences or
disputes with other persons.

(3) Without limiting or derogating from subsection (1) or (2), the Commission,
for the purposes of performing its functions under Part 2A-

   (a)  may do all things necessary to be done in connection with the
        management of its interest in the assigned debt within the meaning of
        Part 2A; and

   (b)  may exercise such other powers in relation to the assigned debt as the
        Treasurer could have exercised but for the enactment of the Transport
        Accident (Amendment) Act 1992.

(4) Without limiting or derogating from subsection (1), the Commission has
power-

   (a)  to apply for, obtain and hold intellectual property rights (including
        patents, copyrights, trade marks and registered designs); and

   (b)  to enter into agreements or arrangements for the commercial
        exploitation within or outside Victoria of those intellectual property
        rights and ancillary services on any terms or conditions as to
        royalties, lump sum payments or otherwise as the Commission may see
        fit; and

   (c)  to enter into agreements or arrangements within or outside Victoria
        for the provision by the Commission of administration, management or
        information systems or services.

(5) Without limiting or derogating from subsection (1), the Commission has
power to do all things necessary or convenient to be done for or in connection
with-

   (a)  acting as an authorised agent under section 23 of the
        Accident Compensation Act 1985; and

   (b)  acting as an agent of a self-insurer under section 143A of the
        Accident Compensation Act 1985.
