Transport Accident Commission

10. Transport Accident Commission



(1) There is established by this Act a Commission by the name of the Transport
Accident Commission.

(2) The Commission-

   (a)  is a body corporate with perpetual succession; and

   (c)  may sue and be sued in its corporate name; and

   (d)  is capable of acquiring, holding, dealing with or disposing of
        property for the purpose of performing its functions and exercising
        its powers; and

   (e)  is capable of doing and suffering all acts and things which bodies
        corporate may by law do and suffer and which are necessary or
        expedient for performing its functions and exercising its powers.

(3) A document is executed by the Commission if the document is signed by-

   (a)  2 Directors of the Board of Management of the Commission; or

   (b)  1 Director of the Board of Management of the Commission and the person
        who is designated by the Board of Management of the Commission to be
        the Secretary to the Board of Management of the Commission.

(4) A person may assume that a document has been duly executed by the
Commission if the document appears to have been signed in accordance with
subsection (3).

(5) All courts, judges and persons acting judicially must take judicial notice
of the signatures on a document which appears to have been signed in
accordance with subsection (3).
