Compensation scheme

46. Compensation scheme



(1) The Minister may, by Order published in the Government Gazette, declare a
scheme established by a trust deed (whether within or outside the State) or
provided by a body corporate (whether within or outside the State) to be an
approved compensation scheme for the purposes of this Act.

(2) The Minister must not declare a scheme to be an approved compensation
scheme unless the Minister is satisfied that the scheme provides that a
decision of the trustees or other person administering the scheme-

   (a)  refusing an application by an applicant for a licence under this Act
        to be a participant in the scheme; or

   (b)  revoking the right of a licensee to be a participant in the scheme-

may be the subject of an application for review to the Tribunal.

(3) A person may make application to the Tribunal for review of a decision of
the compensation scheme trustees referred to in subsection (2).

(4) An application for review must be made within 28 days after the later of-

   (a)  the day on which the decision is made; or

   (b)  if, under the Victorian Civil and Administrative Tribunal Act 1998,
        the person requests a statement of reasons for the decision, the day
        on which the statement of reasons is given to the person or the person
        is informed under section 46(5) of that Act that a statement of
        reasons will not be given.
