Offence to destroy records required by the Act
42D. Offence to destroy records required by the Act
(1) A person must not destroy, conceal, mutilate or alter any record that the
person is required to keep by this Act or the regulations.
Penalty: 100 penalty units.
(2) It is a defence to a charge under subsection (1) if the person charged can
prove that the destruction, concealment, mutilation or alteration of the
document was not done with the intention of defeating the purposes of this
Act.
