Licensee or specified person to produce documents and answer questions
39C. Licensee or specified person to produce documents and answer questions
(1) For the purpose of monitoring compliance with this Act, an inspector may
require a licensee or a specified person at a time and place specified by the
inspector-
(a) to answer orally or in writing any questions put by the inspector
relating to the licensee's business as a travel agent;
(b) to supply orally or in writing information required by the inspector
relating to that business;
(c) to produce to the inspector specified documents or documents of a
specified class relating to that business.
(2) In this section specified person, in relation to a licensee's business as
a travel agent, means-
(a) a person whose licence has been surrendered or cancelled within the
last 3 years; or
(b) a person who is a director or officer of a corporation which is a
licensee; or
(c) if the licence of a corporation has been surrendered or cancelled
within the last 3 years, a person who was a director or officer of the
corporation at the time the licence was surrendered or cancelled; or
(d) a person who is an executor, administrator or trustee (including a
trustee company within the meaning of the Trustee Companies Act 1984)
of the estate of a deceased licensee who is carrying on the business
of the licensee pursuant to this Act.
