38. Right to sue persons providing certain services to unlisted persons



(1) In this section, unlisted person has the same meaning as in section 37.

(2) A person who-

   (a)  suffers loss by reason of an act or omission of an unlisted person;
        and

   (b)  is refused payment of a claim to the compensation trustees in respect
        of that loss-

has a right of action against any person who provided the unlisted person with
goods or services in relation to which the act or omission occurred for
damages in respect of the loss in so far as it involved those goods or
services.
