Definitions
3. Definitions
(1) In this Act-
Authority means the Business Licensing Authority established under the
Business Licensing Authority Act 1998;

compensation scheme means a scheme declared under section 46 to be an approved
compensation scheme for the purposes of this Act;
compensation scheme trustees means the trustees or other person by whom the
compensation scheme is administered;
Consumer Act has the same meaning as it has in the Fair Trading Act 1999;
corresponding Act means any legislation in force in another State, or in a
Territory of the Commonwealth, that provides for the licensing of a person who
carries on business as a travel agent;
director in relation to a body corporate, includes any person occupying or
acting in the position of director of the body corporate, by whatever name
called and whether or not validly appointed to occupy, or duly authorized to
act in, the position;

exempted person means a person to whom, by reason of an order under section 5,
section 6(1) does not apply;
financial institution means-
(a) an authorised deposit-taking institution within the meaning of the
Banking Act 1959 of the Commonwealth; or
(b) a body approved by the Governor in Council by order published in the
Government Gazette;

inspector means an inspector appointed under the Fair Trading Act 1999;
licence means travel agent's licence in force under this Act;
licensee means holder of a licence;

occupier in relation to a premises, means a person who appears to be of or
over 16 years of age and who appears to be in control of the premises;
officer, in relation to a body corporate, has the same meaning as in section
82A of the Corporations Act;

record includes any book, account, document, paper or other source of
information compiled, recorded, stored in written form, or on microfilm, or by
electronic process, or in any other manner or by any other means;
registered means recorded in the register kept under section 15;
Registrar means the Registrar of the Authority appointed under the
Business Licensing Authority Act 1998;
the Director means the Director within the meaning of the
Fair Trading Act 1999;
this Act includes the regulations;
Tribunal means Victorian Civil and Administrative Tribunal established by the
Victorian Civil and Administrative Tribunal Act 1998; trust deed means the
deed of trust made on the twelfth day of December 1986 establishing the
compensation scheme as amended from time to time.
