Offences by a body corporate
41. Offences by a body corporate
(1) If a body corporate commits an offence against this Act, each director or
other person concerned in the management of the body corporate is also guilty
of, and liable to the penalty provided for, that offence unless the director
or other person proves that he or she exercised reasonable diligence to
prevent commission of the offence.
(2) Subsection (1) does not apply to an offence against section 6(2D), 7(5),
8(3) or 9(5).
