16. Victorian Health Promotion Foundation



(1) There is established by this Act a body to be called the Victorian Health
Promotion Foundation.

(2) The Foundation-

   (a)  is a body corporate with perpetual succession; and

   (b)  shall have an official seal; and

   (c)  may sue and be sued in its corporate name; and

   (d)  is capable of taking, purchasing, leasing, holding, selling and
        disposing of real and personal property for the purpose of performing
        its functions and exercising its powers under this Act; and

   (e)  is capable of doing and suffering all such acts and things as bodies
        corporate may by law do or suffer and which are necessary or expedient
        for the purpose of performing its functions and exercising its powers
        under this Act.

(3) The Foundation represents, and shall be taken to be part of, the Crown.

(4) The official seal of the Foundation shall be kept in such custody as the
Foundation directs and must not be used except as authorised by the
Foundation.

(5) All courts, judges and persons acting judicially shall take judicial
notice of the seal of the Foundation affixed to a document and shall presume
that it was duly affixed.
