Secretary to Department subject to Ministerial direction

7A. Secretary to Department subject to Ministerial direction



(1) The Secretary to the Department-

   (a)  is subject to the general direction and control of the Minister; and

   (b)  must comply with any specific direction given by the Minister.

(2) The Minister cannot give to the Secretary any direction as to the quantum
of any amount payable under section 68 of the Rail Corporations Act 1996 for
breach of a civil penalty provision within the meaning of that section.
