Power to issue arrest warrant

30. Power to issue arrest warrant



(1) If the offender fails to appear at a hearing under this Part, the court
may, on application by the Secretary, issue a warrant for the arrest of the
offender if satisfied by evidence on oath or by affidavit-

   (a)  that notice of the hearing was served on the offender; or

   (b)  that there are reasonable grounds to believe that the offender is
        evading service of notice of the hearing.

(2) A court may also issue an arrest warrant if satisfied that an offender who
is the subject of an application made to it under this Part has absconded or
is unlikely to attend a hearing held under this Part.
