Offences

16. Offences



(1) Any person who sells any land in contravention of the provisions of this
Act shall be guilty of an offence against this Act and where no other penalty
is expressly provided be liable to a penalty of not more than 10 penalty
units.

(4) Notwithstanding anything in this section it shall be a defence to a
prosecution under this section if the defendant satisfies the court-

   (a)  that at the time of the alleged contravention of the provisions of
        this Act-

   (i)  he was a licensed estate agent within the meaning of the
        Estate Agents Act 1980; and

   (ii) he had acted only as agent for the vendor in connexion with the sale;
        and

   (b)  that he had acted honestly and reasonably and ought fairly to be
        excused in all the circumstances of the case.
