Non-commercial activities

72. Non-commercial activities



(1) The relevant Minister, with the approval of the Treasurer, and a State
owned company may enter into an agreement under which the company, in
accordance with its memorandum and articles, agrees to perform, or to cease to
perform, activities in circumstances where the board considers that it is not
in the commercial interests of the company to do so.





(2) The terms and conditions of an agreement under subsection (1) may include
provision for reimbursement to the company by the Minister administering Part
2 of the Financial Management Act 1994 for the net cost to the company of
complying with the agreement.
