Minister may bring proceedings

37. Minister may bring proceedings

If a person contravenes section 36 in relation to a State business
corporation, the relevant Minister, in the name of the corporation, may
recover from the person as a debt due to the corporation by action in a court
of competent jurisdiction either or both of the following:

   (a)  If that person, or any other person, made a profit as a result of the
        contravention, an amount equal to that profit;

   (b)  If the corporation has suffered loss or damage as a result of the
        contravention, an amount equal to that loss or damage.
