Suspension of timber harvesting operation

71. Suspension of timber harvesting operation



(1) An authorised officer may issue a suspension notice to suspend any timber
harvesting operation in a State forest if the authorised officer is of the
opinion that-

   (a)  there has been a failure to comply with a direction under section 70;
        and





   (b)  continuation of the timber harvesting operation would cause-

   (i)  imminent damage to the environment; or

   (ii) a serious risk to the safety of any person.

(2) A notice under subsection (1) may be issued to-

   (a)  the holder of a timber harvesting operator's licence; or

   (b)  the person who has, or may reasonably be presumed to have, control
        over the timber harvesting operation in the State forest.
