54. Issue of licence



(1) The Secretary may issue a timber harvesting operator's licence to an
applicant if the Secretary is satisfied that the applicant has the appropriate
qualifications, competencies or experience to carry out the prescribed
activity or class of activity to which the application for the licence
relates-

   (a)  in a safe manner; and

   (b)  in accordance with any Code of Practice relating to timber harvesting.

(2) A timber harvesting operator's licence must specify the prescribed
activity or class of activity to which the licence relates.

(3) A timber harvesting operator's licence-

   (a)  is for a period not exceeding 3 years; and

   (b)  is not transferable.
