Supreme Court Act 1986 - SECT 33H

Originating process

33H. Originating process



(1) A group proceeding must be commenced by writ.

(2) The indorsement on the writ must, in addition to any other matters
required by the Rules to be included-

   (a)  describe or otherwise identify the group members to whom the
        proceeding relates; and

   (b)  specify the nature of the claims made on behalf of the group members
        and the relief claimed; and

   (c)  specify the questions of law or fact common to the claims of the group
        members.

(3) In describing or otherwise identifying group members for the purposes of
subsection (2), it is not necessary to name, or specify the number of, the
group members.
