Proceedings for offences

61. Proceedings for offences



(1) Subject to subsection (2), proceedings under this Act may be brought-

   (a)  by the Board; or

   (b)  in the name of the Board by a person authorised by the Board.

(2) The Surveyor-General may bring proceedings for an offence against section
38 or 39 or any other offence involving the survey control network.

(3) Any prosecution instituted in the name of the Board or the
Surveyor-General must, in the absence of evidence to the contrary, be taken to
have been instituted by the Board or the Surveyor-General, as the case may be.
