Constitution of a panel for a formal hearing

25. Constitution of a panel for a formal hearing



(1) A panel appointed under section 24 must consist of not less than 3 members
of the Board of whom-

   (a)  one must be a licensed surveyor; and

   (b)  one must be a lawyer.

(2) A member of the Board who has undertaken a preliminary investigation of a
matter which is the subject of a formal hearing is not eligible to be a member
of the panel for that hearing.

(3) If-

   (a)  the Board is unable to appoint a panel because there are not enough
        suitably qualified members available to sit on it; or



   (b)  the Board is of the opinion that a person with special expertise is
        required for the hearing-

the Minister may fill the vacant positions on the panel by appointing persons
who are not members of the Board.
