Meaning of penalty units
110. Meaning of penalty units
(1) If in an Act or subordinate instrument (except a local law made under Part
5 of the Local Government Act 1989) there is a statement of a number (whether
whole, decimal or fractional) of what are called penalty units, that statement
must, unless the context otherwise requires, be construed as stating a number
of dollars equal to the product obtained by multiplying the number of penalty
units by the amount fixed from time to time by the Treasurer under
section 5(3) of the Monetary Units Act 2004.
(2) If in a local law made under Part 5 of the Local Government Act 1989 there
is a statement of a number (whether whole, decimal or fractional) of what are
called penalty units, that statement must, unless the context otherwise
requires, be construed as stating a number of dollars equal to the product
obtained by multiplying $100 by that number of penalty units.
