Valuation of land for public open space

19. Valuation of land for public open space



(1) The Council may obtain a valuation of the land from a person who holds the
qualifications or experience specified under section 13DA(1A) of the
Valuation of Land Act 1960 if the value is not agreed.

(2) The land is to be valued on a day not more than 12 months before the date
for payment of the public open space contribution.

(3) The Council must give the applicant a copy of the valuation.

(4) Part III of the Valuation of Land Act 1960 (except Division 2) applies to
the valuation as if the valuation had been made under Part 8 of the
Local Government Act 1989.



(5) If a public open space contribution is not paid within 12 months after it
is required, the Council may obtain a revaluation at each anniversary of the
making of the requirement, and vary the amount of the payment accordingly.
