8. Residence right not to be created unless retirement village notice is
lodged



(1) A person who after the commencement of this section-

   (a)  enters into a contract; or

   (b)  invites other persons to make applications, offers or proposals to
        enter into a contract-

which has or would have the effect of creating or giving rise to a residence
right in a retirement village in respect of which a retirement village notice
has not been lodged under section 9 is guilty of an offence. Penalty: 200
penalty units.

(2) A person who is a resident and has entered into a contract in respect of
which there has been a contravention of subsection (1) may rescind the
contract.
