Application to Director to investigate need for non-urgent repairs
74. Application to Director to investigate need for non-urgent repairs
(1) A tenant may apply to the Director to investigate whether the landlord is
in breach of a duty to ensure that the premises are maintained in good repair
if-
(a) the tenant has given the landlord written notice advising the landlord
that repairs (other than urgent repairs) are required to the rented
premises; and
(b) the landlord has not carried out the repairs within 14 days after
being given the notice.
(2) An application under subsection (1) must be in writing.
(3) On an application under subsection (1), the Director-
(a) must investigate; and
(b) may negotiate arrangements for the carrying out of repairs if the
Director is satisfied that the landlord is in breach of the duty to
maintain the rented premises in good repair; and
(c) must give a written report to the tenant.
