Maximum amount of certain guarantees

38. Maximum amount of certain guarantees



(1) If a tenant-

   (a)  has not paid a bond or has not been required to pay a bond; and

   (b)  has obtained a guarantee in relation to a tenancy agreement-

the guarantee is unenforceable against the guarantor to the extent to which
the amount guaranteed exceeds the amount of rent payable under the tenancy
agreement for 1 month.

(2) This section does not apply to a tenancy agreement referred to in section
31(2) or (3).
