Certain guarantees prohibited

37. Certain guarantees prohibited



(1) A person must not demand or require a tenant to obtain a guarantee for the
performance of any of the tenant's duties in relation to the tenancy agreement
if the tenant has paid or is required to pay a bond under a tenancy agreement.

Penalty: 10 penalty units.

(2) This section does not apply to a tenancy agreement referred to in section
31(2) or (3).

(3) A guarantee obtained in contravention of this section is invalid and
unenforceable.
