RESIDENTIAL TENANCIES ACT 1997 - SECT 332
Order not to be made in certain circumstances(1) Despite section 330, the Tribunal must not make a possession order if—
S. 332(1)(a) amended by Nos 67/2010 s. 31(a), 45/2018 s. 240A(Sch. 1 item 16) (as amended by No. 47/2019 ss 83, 90).
(a) the application for the order is supported with a notice to vacate given under section 91ZO, 142ZG, 206AW or 207ZA; and
(b) the Tribunal is satisfied that—
(i) the failure to comply with an order of the Tribunal was trivial or has been remedied as far as possible; and
S. 332(1)(b)(ii) repealed by No. 45/2018 s. 247(1).

(iii) the breach of duty is not a recurrence of a previous breach of duty.
