Railways to which this Act does not apply

6. Railways to which this Act does not apply

This Act does not apply to-

   (a)  a railway in a mine that is underground, or chiefly underground, and
        that is used in connection with the performance of mining operations;
        or

   (b)  a railway that is operated solely within an amusement or theme park;
        or

   (c)  a slipway; or

   (d)  a railway used only to guide a crane; or

   (e)  an aerial cable operated system; or

   (f)  a railway that the regulations state is a railway to which this Act
        does not apply.
