Offence to teach driving without driving instructor authority or in breach of condition of authority

33A. Offence to teach driving without driving instructor authority or in
breach of condition of authority



(1) A person who for financial gain, or in the course of any trade or
business, teaches another person to drive a motor vehicle of a kind described
in section 33(3) on a highway-

   (a)  without holding a driving instructor authority; or

   (b)  in breach of any condition of such an authority-

is guilty of an offence. Penalty: 8 penalty units.

(2) It is a defence to a charge under subsection (1) for the person charged to
prove that the person being taught to drive held a driver licence at the time
of being taught.
