Offence to employ unlicensed driver

32. Offence to employ unlicensed driver



(1) A person who employs, permits or allows a person to drive a motor vehicle
on a highway is guilty of an offence if the driver does not hold a permit or
licence which authorises him or her to drive such a motor vehicle.

Penalty: 15 penalty units or imprisonment for 3 months.

(2) It is a defence to a charge under subsection (1) for the person charged to
prove that the person charged believed, after making all reasonable enquiries,
that the driver held a permit or licence which authorised him or her to drive
the motor vehicle concerned.

(3) A person who is employed to drive a motor vehicle on a highway is guilty
of an offence if he or she does not notify his or her employer if he or she
does not hold or continue to hold a permit or licence which authorises him or
her to drive such a motor vehicle.
