General powers of authorised officers

74. General powers of authorised officers



(1) Subject to subsection (2), for the purposes of the administration of this
Act and the regulations, an authorised officer may exercise the powers
conferred by or under this Act and the regulations to ascertain whether the
provisions of this Act or the regulations have been, or are being, complied
with.

(2) Unless an authorised officer is of the opinion that it is necessary to do
so because of an emergency, an authorised officer must not enter any privately
owned property unless-

   (a)  the owner has given consent; or

   (b)  the authorised officer has given the owner reasonable notice of the
        intention to enter at a reasonable time.
